Terms and Conditions for the installation and use of TBayTel's Enhanced Security Suite.
Use of TBAYTEL's Desktop Anti-Virus, Desktop Anti-Spyware, Desktop Firewall, and/or Content Filtering Service, collectively referred to as "ENHANCED SECURITY SUITE", shall be subject to the following:
  1. Desktop Anti-Virus Effectively protect your computer from viruses with comprehensive anti-virus technology.
  2. Desktop Anti-Spyware and Pop up Blocker Spyware protection is easy to use and stops spyware before it can crash your computer. Ad and pop-up blocking is also included.
  3. Desktop Personal Firewall Advanced firewall technology which automatically senses non-conforming Internet applications during the installation and operation of your computer.
  4. Web-based Parental Controls A Content Filtering Service that allows you to filter access to online content generally located in, but not restricted to, websites based on categories chosen by you during the set-up process. TBayTel's Parental Controls are not intended to be a substitution for parental supervision.
  5. Other. All intellectual property rights in TBAYTEL's ENHANCED SECURITY SUITE and associated documentation and software, are owned by TBayTel, or its suppliers, and are protected by applicable intellectual property laws. TBayTel and its suppliers retain any and all rights not expressly granted herein.
You agree to waive, and will not assert, any claims against TBayTel or its suppliers in connection with your access to or use of TBayTel's Enhanced Security Suite, including without limitation any claims based upon the (1) deletion, misdirection or delay of your email, records or data; or (2) damages claimed by you based on a third party claim.

YOU UNDERSTAND AND AGREE THAT THE ENHANCED SECURITY SUITE PROVIDED BY TBAYTEL IS PROVIDED "AS IS." TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TBAYTEL DISCLAIM ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE ENHANCED SECURITY SUITE, INCLUDING WITHOUT LIMITATION ALL WARRANTIES OF MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE (EVEN IF ADVISED OF SUCH PURPOSE), TITLE AND NON-INFRINGMENT, AND AGAINST ERROR-FREE OR UNINTERRUPTED ENHANCED SECURITY SUITE. EXCEPT AS OTHERWISE SET OUT IN THESE TERMS AND CONDITIONS, YOU ASSUME THE ENTIRE COST OF ANY DAMAGE, LOSSES OR EXPENSE RESULTING FROM YOUR ACCESS TO AND USE OF THE ENHANCED SECURITY SUITE. IN NO EVENT SHALL TBAYTEL OR ITS SUPPLIERS BE LIABLE FOR ANY DAMAGES WHATSOEVER OR HOWSOEVER CAUSED (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF SALES, LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF DATA, OR THIRD PARTY CLAIMS) ARISING OUT OF ACCESS TO OR USE OF THE ENHANCED SECURITY SUITE OR THIS AGREEMENT.
